Snacks and beverage giant PepsiCo India has filed a trademark violation case against moved Mumbai-based beverage major Parle Agro in the Delhi High Court over the use of the tagline ‘For The bold’ for its B-Fizz drink.
PepsiCo India has sought a permanent injunction against Parle Agro from the use of the tagline which doing so would result in “violation of the statutory and exclusive proprietary rights of the Plaintiff No.1 in its registered trade mark/tagline "For The Bold".”
The snacks and beverage giant has used “For The Bold’ as a tagline for its tortilla chips brand Doritos since 2013. Parle Agro, on the other hand, launched ‘B-Fizz’ in October last year (2020).
PepsiCo India has sought damages to the tune of Rs 2 crore and An order for delivery up for destruction upon oath of all products including bottles, cans, packing material, stationery, carry bags, price stickers, visiting cards, billboards, brochures, promotional material, point of sale material, letter heads, cash memos, sign boards, sign posts, leaflets, cartons or any other items of whatsoever description and nature, bearing the expression/tagline "For The Bold"
On June 3, the court asked Parle Agro to submit a response within 30 days. The next hearing in on July 16.
